1. Acceptance of the general conditions of use
Welcome to the ASHWI site "www.ashwi.fr", hereinafter the "ASHWI Site" which allows you to access all the services (hereinafter the "Services") provided by ASHWI, 19 rue du Sausset 93290 Tremlay -in France.
Please read the General Conditions of Use carefully, print them out and keep a copy.
2. Description
ASHWI is a website that allows consumers to view the various products of the brand.
 
Services means all activities and products provided by ASHWI to its members and users.
 
The Users designate the Members of ASHWI and undertake to respect and honor these General Conditions of Use.
 
Members designate ASHWI users who have registered on ASHWI by completing the personal information forms and having obtained confirmation of access to the ASHWI site.
 
Publication and revision of the General Conditions of Use 
 
ASHWI authorizes the modification of the General Conditions of Use, the name of the brand, the location of its offices, its representatives, telephone numbers intended for its users at any time as long as they do not go to the against laws or legal right.
 
ASHWI authorizes itself to modify, correct, change each of its General Conditions of Use whatever the reason.
 
In this case, the publication of the revision made to the General Conditions of Use, the reason as well as the effective date must appear at least one week in advance.
 
If a Member does not accept this revision, then he can terminate the service and cancel his membership. If the Member continues to use the service after the effective date of the revision, the latter will be considered as consenting to the revision and to the new General Conditions of Use.
 
No rule or article of these General Conditions of Use should go against the law.
3. ASHWI provides the following services:
  • Shooting from different angles of the requested products
  • The computer storage of its files as well as the guarantee of their confidentiality
  • Putting products online
4. Service interruption
ASHWI may interrupt or suspend its services in the following cases:
  • Periodic maintenance of equipment, system failure, loss of connection.
  • ASHWI must inform its members for each interruption of service.
However, ASHWI declines all responsibility for damages suffered as a result of an interruption not resulting from the negligence of the company or as a consequence of events beyond the control of ASHWI.
5. Registration
Registration is free for Buyer customer accounts. By registering, Buyers undertake to respect the T & Cs.
 
All information provided during registration must be correct. The registration form must be duly completed to be validated.
 
Any false or erroneous information will result in the complete and final closure of the account in question and may result in prosecution.
 
ASHWI reserves the right to refuse a registration.
 
ASHWI alone can provide access to its services and technology.
 
Registration is only validated after the approval of ASHWI, which will inform the new account by notification.
 
It is only after the validation of the registration that a member will be able to fully enjoy the services provided by ASHWI.
 
A member must immediately inform ASHWI of any change in information presented during registration.
6. Termination of registration
A member can at any time ask ASHWI to terminate his account and this request will be executed immediately.
 
ASHWI may restrict or suspend a member's registration in the following cases:
 
  • The verified information of the registrant is false or erroneous.
  • Unauthorized use of login and passwords or any other information.
  • An abusive or diverted use of the service which would go beyond the commercial and legal framework offered by ASHWI.
  • Harm or intent to harm the image of other members and / or interests in Madison.
  • Links or redirection to sites of a sexual or pornographic nature.

ASHWI reserves the right to suspend a member's account at any time for any violation of an article contained in object 2. In the event of a repeat offense, ASHWI reserves the right to ban a member.
 
Before the exclusion of a member, ASHWI will send him a notification and offer the latter the opportunity to regularize his situation before this final action.
7. Tariff
The products are displayed in euros and excluding taxes for the countries of the European community, including France (on condition of providing us with a compliant intra-community VAT number) at the price of the tariff in force on the day the order is registered by ASHWI excluding delivery charges.
8. Terms of Payment
The products are payable in cash on the day of the actual order.
Payment for purchases is made by credit card, bank transfer, or over the phone.
9. Product availability
Our products are offered within the limits of available stocks.
 
The photographs reproducing the products are not contractual.
 
Information on product availability is provided at the time of placing your order.
 
In case of unavailability of a product, after placing your order, we will inform you by email as soon as possible and you can then, if you wish, cancel your order.
10. Order

11. Order confirmation / Modification / Cancellation
ASHWI will confirm orders placed by email by users within 2 working days.
 
If users observe an anomaly in the order confirmation, they must immediately inform ASHWI of their intention to modify their order.
 
If a user requests an order modification or cancellation before their merchandise is shipped, ASHWI will submit the request to those concerned.
12. Shipping / delivery
If an order for merchandise is made, ASHWI must specify the type of shipment. ASHWI is not responsible for any delay caused by the carrier.
 
The buyer must specify the type of delivery he wishes for the order of his goods.
 
ASHWI must get in touch with the carrier and arrange for the removal of the goods, taking into account the order preparation times as well as the customer's request. The customer can also contact his carrier. If the terms cannot be met, ASHWI must immediately contact the Purchaser in order to reach an agreement on the new delivery terms.
13. Liability
ASHWI ensures to maintain the security and protection of personal data.
 
ASHWI recognizes its responsibility for losses resulting from any misinformation provided by the site.
 
ASHWI undertakes not to send email notifications for marketing or commercial purposes to users who have expressly requested them.
14. Protection of personal information
ASHWI is committed to collecting only the minimum information required to fully provide its services.
 
ASHWI will ask for the user's prior consent each time the user provides information that can be saved.
 
Personal information submitted to ASHWI will not be used for purposes not specified in our policy without the prior consent of the user, nor will it be passed on to third parties. ASHWI will assume its moral responsibilities for any damages due to unauthorized dissemination of this information except in the following cases:
  • User contact and shipping information (name, address, phone number) must be provided to carriers in the ordering process.

If ASHWI requires user authorization as in paragraphs 2 and 3 of this section, it will specify the information disclosed:
  • The purpose of collecting information.
    Information concerning the person responsible for data management (department, name, telephone number).
  • Intent to use the information.
  • The interested recipient of the information.
  • Users can withdraw their authorization at any time.

Users can contact ASHWI and request the rectification or correction of their personal information. ASHWI will not use user information until it is completely updated.
 
ASHWI will limit the number of personnel having access to user information in order to protect their integrity.
 
ASHWI will limit the use of the information to the use stipulated in paragraph 1.
15. Username and password
Members are responsible for the use of their own username and password with the exception of the cases mentioned in section 14.
 
Members must under no circumstances communicate their access to a third party.
 
If a member becomes aware that an unauthorized person is using their credentials, they must immediately notify ASHWI and follow the instructions given to them. ASHWI cannot be held responsible for any damage or loss caused within the scope of fields 1, 2 and 3.
16. Liability of members
Users should not:
  • Submit incorrect information when registering or changing their member information.
  • Change any information posted on ASHWI without approval.
  • Post or upload information disapproved by ASHWI.
  • Infringing the right to the image of ASHWI or any other sites.
  • Infringing copyright or interfering with the operation of ASHWI or other linked sites.
  • Post illegal (counterfeit type), violent, pornographic elements in the form of a message, image or sound.
ASHWI is responsible for the information they disseminate.
 
ASHWI reserves the right to restrict any content posted on the site by members if it deems it necessary.
17. Copyright
ASHWI reserves all copyrights on its site. Any violation of these rights is subject to prosecution by ASHWI.
 
Users cannot appropriate ASHWI images or copyrights.
 
Users must not use the information obtained through access to ASHWI for commercial purposes without its consent and authorization in any form including and not limited to copying, transmission, publication, distribution or dissemination. .
 
ASHWI cannot be held responsible for the content posted by its members.
18. Exemptions
ASHWI cannot be held responsible for any interruption of service due to a natural disaster or an event or phenomenon which is beyond its control and which cannot be predicted.
 
ASHWI cannot be held responsible for any interruption of service due to problems encountered in users' systems.
 
ASHWI is not responsible for damages and consequences in the event of incomplete or outdated information.
 
ASHWI disclaims all liability and damage caused by the negligence of users to themselves and others.
19. Mailing
ASHWI will transmit all information via the email address given during user registration.
20. Links to other sites
ASHWI can redirect users to other sites by hypertext links on images or texts.
 
ASHWI cannot be held responsible for transactions carried out following user redirection.

22. Complaints
In order to increase visibility and financial returns, ASHWI reserves the right to advertise on its site or via emails.
 
However, any user who explicitly requests it will no longer receive an advertising email.
23. Lawsuits
The customer service is responsible for receiving, collecting and analyzing the opinions and complaints of users and undertakes to do what is necessary to meet the expectations of the latter. Customer satisfaction being our main interest.
 
Customer service undertakes to take charge of complaints as soon as possible and to find the most equitable and just solution.
24. Applicable law - Attribution of jurisdiction
In the event that the Customer is of foreign nationality, it is agreed that the orders concluded between the latter and ASHWI will remain subject to French law.
 
It is agreed that all disputes between the parties and which they could not resolve amicably, will be submitted to the COMMERCIAL COURT of Paris, to which the parties attribute territorial jurisdiction regardless of the place of performance or the domicile of the defendant. This clause by express agreement of the parties also applies in the event of summary proceedings, multiple defendants or warranty claims.
